ARE YOU A GRANDPARENT?
It will not come as any surprise to readers of this article who knew that the role of grandparents in family unit is as important as ever.
Unfortunately, however, due to family breakdowns or disputes then grandparents might find themselves being prevented from spending time with the grandchildren.
In court proceedings, the welfare of the child is always paramount. Often children have very deep and meaningful relationships with grandparents and a sudden void in the lives of children can cause emotional harm.
Grandparents do not have automatic rights to apply to the court for child arrangements orders and require the courts permission to make any such application. The courts have to consider the depth of the previous relationship between the children and grandparents and those grandparents have played a significant role in the lives of a child the court are more likely to be granted permission to make such an application.
The court will consider various factors such as :
- the nature of your application ;
- the grandparents connection with the child ;
- any potential risk that might rise for the child if the proposed order were to be made.
If the court believes the application is genuine and in the child’s best interests they will grant permission for the grandparent to make that application.
If you find yourself in a situation where you are prevented from spending time with your grandchildren, the first step to take would be to attempt mediation with the children’s parents.
