Court Proceedings Brought By The Local Authority – Care And Supervision Orders
These are more commonly known as Care proceedings – when the Local Authority makes an application to the Court for a Care or Supervision Order in relation to a child. This will be because of concerns that a child is at risk of significant harm and the Local Authority make their Court application for permission to take action to protect the child.
A Care Order is where a Local Authority is given parental responsibility for a child and shares it with the child’s parents.
A Supervision Order imposes a duty on the Local Authority to “advise, assist and befriend” a child. A child is likely to remain living with their parents under a Supervision Order, and it does not give the Local Authority parental responsibility (as a Care Order does).
Legal Aid is automatically available if you are a parent or person with parental responsibility for the child involved in Care proceedings. If you receive notice that the Local Authority are starting, or have started Care proceedings for your child, it is vital that you contact us straightaway.
